  1. Basic provisions

    T-Mobile Czech Republic a.s., registered office: Tomíčkova 2144/1, Praha 4, registered at the Municipal Court in Prague, Section B, Entry 3787, company registration number: 649 49 681, tax identification number: CZ649 49 681, hereby publishes the rules and terms and conditions for the use of the portal www.t-mobile.cz (hereinafter referred to as ‘TMCZ’ and ‘Rules’).

    For the purposes of these Rules, ‘portal’ shall mean the website accessible from the address www.t-mobile.cz (hereinafter referred to as ‘Portal’).

    The owner and operator of the website at www.t-mobile.cz forming the Portal is TMCZ, which, pursuant to Act No. 121/2000 Coll., the Copyright Act, is entitled to exercise proprietary rights in respect of this website (hereinafter referred to as ‘Operator’). Operator shall hold any and all copyrights to the actual content placed by Operator on the Portal pages, including the text, content design, technical sketches, graphics, and all depictions on these pages, and to the choice and method of structuring the files contained on the Portal pages.

    The rights and obligations of Operator and users in the use of the Portal shall be governed by these Rules. These Rules apply to all persons who visit the Portal (hereinafter referred to as ‘Users’). Users express their consent to these Rules by entering any of the websites of Operator accessible via this Portal and using any information posted on the websites accessible via the Portal. For the use of services provided by Operator via the Portal, besides these Rules, the General Terms and Conditions of T-Mobile Czech Republic a.s. and any special terms and conditions that may exist for a particular service shall also apply. References to special terms and conditions, if they exist for a particular service, are contained in the provisions on the specific service.

    The publication of any data or information on the website at www.t-mobile.cz, with the exception of these Rules, does not, by nature, constitute a legal transaction leading to the emergence of a legal relationship between Operator and Users, unless expressly specified to the contrary in individual cases.

  2. Completeness and updating of information

    Operator shall take all efforts to ensure that the information on this Portal is up-to-date; therefore this information is regularly modified and checked. However, Operator cannot guarantee the accuracy, correctness, and topicality of all the content thereof in all cases. The information published on the Portal is basic information on the range of products, services, and activities of Operator, and is intended to be of a general informative nature.     Operator reserves the right, without prior notification, to amend and modify the information supplied.

  3. Operator’s responsibility for content

    Operator is responsible for the content posted and maintained for use on the websites within the Portal. Operator is not responsible for the content of other parties to which Operator only mediates access. Operator is not responsible for the content of other parties located within the Portal if this content is not known to Operator or if it is not technically possible and acceptable for Operator to prevent the use of such content.

    Operator therefore carries no responsibility for:

    – the content of websites belonging to third parties that can be visited via Operator’s Portal;

    – links to the websites of third parties placed on the Portal;

    – advertising or other forms of promotion carried out by any third party via Operator’s Portal;

    – the content of messages exchanged by Portal Users via the Portal.

    Operator shall be entitled to remove, at any time, any Portal content which is inconsistent with the legislation of the Czech Republic or good morals, which endangers the public order, or which, in terms of content, is not compatible with Operator’s interests. In particular, Operator shall be entitled to remove deceptive and untrue content, content encroaching on the rights and warranted interests of third parties, content that is against human dignity, discriminating from the aspect of religion, creed, race, or sex, or which promotes violence or any other unlawful conduct.

  4. Use of the Portal by Users

    In the use of this Portal, Users shall be governed by the legislation in force in the Czech Republic; Users shall act in accordance with good morals, the rules of fair business practices, and these Rules; Users shall not harm the name and rights of Operator or other Users.

    In particular, Users shall not:

    – use all or individual parts of the Portal for purposes other than their own requirements; in particular Users shall not copy, download, or disseminate the content of the Portal pages beyond the scope of their own requirements

    – interfere with the content or technical essence of the Portal pages without Operator’s permission

    – interfere with the security of the Portal

    – interfere with the use of this Portal by other Others or prevent other Users from using the Portal in any way

    – use the Portal to distribute unsolicited messages (Spam) or chain messages

    – send messages to this Portal which contain viruses, or any dangerous or harmful programs

    – create fake messages in order to falsify the identity of the sender, or try to penetrate the accounts of other Users

    – attempt to gain access to the pages of this Portal which are not intended for public use

    – disseminate any messages or materials on the pages of this Portal which breach the legislation of the Czech Republic, good morals, endanger public order, or which by content are incompatible with Operator’s interests. In particular, Users shall not disseminate deceptive or untrue messages or materials, materials which encroach on the rights and warranted interests of third persons which are inconsistent with human dignity, which by content are discriminating from the aspect of religion, creed, race, or sex, or which promote violence or any other unlawful conduct

  5. Access to pages and the protection of personal data

    Access to and use of the website at www.t-mobile.cz is free of charge.

    Operator may make access to the website at www.t-mobile.cz entirely or partially conditioned by the provision of certain personal data of Users in accordance with Act No. 101/2000 Coll., on the protection of personal data. Operator shall handle these data in accordance with legislation in force and shall use such data only in the scope required to fulfil the purpose for which these personal data are obtained, and shall prevent any injury to persons whom the data concern.

    The authority supervising the provision of on-demand audio-visual media services shall be the Council for Radio and Television Broadcasting.

  7. Final provisions

    Rules for the use of the Portal enter into force and effect on the date of publication thereof. The moment of publication shall be the moment that the Rules are posted on the footer of Operator’s websites accessible from the Portal.

    Only Operator shall be entitled to change or amend these Rules. Operator shall be entitled to change the Rules at any time. Operator shall notify any change in the Rules by means of an announcement on the Portal’s website. Users express their consent to the new wording of the Rules by continuing to use the Portal.

    In the event of any inconsistencies between the Czech and English version of any information on the website of the Portal, the Czech version shall be final.

Declaration of website accessibility

When creating websites we take into account the Best Practice – Rules on the Creation of Accessible Web methodological instructions (Best Practice – Pravidla pro tvorbu přístupného webu) of the Ministry of Informatics and Communications, the main standards of the Web Content Accessibility Guidelines, Blind Friendly Web methodological instructions (project of Czech Blind United) and W4D principles. However, due to the fact that it is necessary to maintain a uniform style of internet presentations within the T-Mobile group, some inadvisable features (e.g. interactive flash) remain.

The website content and layout are created with the structural XHTML 1.0 Transitional, the graphics with Cascading Style Sheets (CSS). The text sizes are defined in relative units and can be easily increased or decreased by means of standard internet-browser tools.

The layout and control of the websites is designed to make the websites accessible for both alternative browsers, as well as for persons with specific needs (by means of alternative content).
